Chapter I General Provisions


Article 1 These Regulations are formulated to strengthen emergency response to power safety accidents, standardize investigation and handling of power safety accidents, and control, mitigate and eliminate damage caused by power safety accidents.


Article 2 Power safety accidents as mentioned in these Regulations refer to accidents that occur during power production or power grid operation and affect the safe and stable operation of the power system or the normal supply of power (including accidents that occur in thermal power plants and affect the normal supply of heat).


Article 3 According to the extent to which power safety accidents (hereinafter referred to as accidents) affect the safe and stable operation of the power system or the normal supply of power (heat), accidents are divided into extremely serious accidents, serious accidents, major accidents and general accidents. The accident classification standards are listed in the Appendix to these Regulations. If some items of the accident classification standards need to be adjusted, the State Council Power Regulatory Agency shall propose a plan and submit it to the State Council for approval.


For cities where provincial people's governments are located and powered by provincial power grids that are independent or connected to other provinces through a single transmission line, and other cities and county-level cities powered by a single transmission line or a single substation, the accident classification standards for power grid load reduction or power outages for power users shall be separately formulated by the State Council Power Regulatory Agency and submitted to the State Council for approval.


Article 4 The power regulatory agency of the State Council shall strengthen the supervision and management of power safety, establish and improve various systems for emergency response and investigation and handling of accidents in accordance with the law, and organize or participate in the investigation and handling of accidents.


The power regulatory agency of the State Council, the energy regulatory department of the State Council and other relevant departments of the State Council, local people's governments and relevant departments shall organize, coordinate and participate in the emergency response of accidents in accordance with the powers and procedures prescribed by the state.


Article 5 Power enterprises, power users and other relevant units and individuals shall abide by the power safety management regulations, implement accident prevention measures, prevent and avoid accidents.


Important power users determined by the relevant departments of the local people's governments at or above the county level shall configure self-provided emergency power supplies in accordance with the regulations of the power regulatory agency of the State Council, and strengthen the management of safe use.


Article 6 After the accident occurs, power enterprises and other relevant units shall report the accident in a timely and accurate manner in accordance with the regulations, carry out emergency response work, prevent the accident from expanding, and reduce the damage caused by the accident. Power enterprises shall resume power production, power grid operation and normal power (heat) supply as soon as possible.


Article 7 No unit or individual shall obstruct or interfere with the reporting, emergency response and investigation and handling of accidents in accordance with the law.


Chapter II Accident Report


Article 8 After an accident occurs, the relevant personnel at the accident site shall immediately report to the operating duty personnel of the power plant or substation, the duty personnel of the power dispatching agency or the on-site person in charge of the enterprise. After receiving the report, the relevant personnel shall immediately report to the power dispatching agency at the next higher level and the person in charge of the enterprise. After receiving the report, the person in charge of the enterprise shall immediately report to the local dispatched agency of the State Council's power regulatory agency (hereinafter referred to as the power regulatory agency at the place where the accident occurred) and the safety production supervision and management department of the people's government at or above the county level; if the accident of a thermal power plant affects the normal supply of heat, it shall also report to the heat supply management department; if the accident involves the safety of the dam of a hydropower plant (station), it shall also report to the competent water administration department or river basin management agency at the same time.


Power enterprises and their relevant personnel shall not delay, omit, conceal or falsely report the accident.


Article 9 After receiving the accident report, the power regulatory agency at the place where the accident occurred shall immediately verify the relevant situation and report to the power regulatory agency of the State Council; if the accident causes power outages to power users, it shall also notify the local people's government at or above the county level where the accident occurred.


For particularly serious accidents and serious accidents, the State Council's power regulatory agency shall immediately report to the State Council upon receipt of the accident report, and inform the State Council's production safety supervision and management department, the State Council's energy department and other relevant departments.


Article 10 The accident report shall include the following contents:


(a) The time, location (region) and unit where the accident occurred;


(b) The known damage to power equipment and facilities, the number of power generation (heating) units that have been shut down, the value of power grid load reduction or power plant output reduction, and the scope of power outage (heating outage);


(c) The preliminary judgment of the cause of the accident;


(d) The measures taken after the accident, the power grid operation mode, the operating status of the generator set and the accident control situation;


(e) Other situations that should be reported.


If new situations arise after the accident report, they should be reported in a timely manner.


Article 11 After an accident occurs, the relevant units and personnel shall properly protect the accident site and relevant materials such as work logs, work tickets, operation tickets, etc., and promptly preserve relevant materials such as fault recording diagrams, power dispatching data, generator set operation data, and power transmission and transformation equipment operation data, and transfer relevant materials and information to the accident investigation team after the accident investigation team is established.


If it is necessary to change the accident site or move power equipment due to emergency measures such as rescuing personnel or restoring power production, power grid operation and power supply, it shall be marked, a simple on-site diagram shall be drawn, important traces and physical evidence shall be properly preserved, and written records shall be made.


No unit or individual shall intentionally destroy the accident site, forge, conceal or destroy relevant evidence.


Chapter III Emergency Response to Accidents


Article 12 The State Council’s power regulatory agency shall organize the preparation of a national emergency plan for handling large-scale power outages in the power grid in accordance with the Law of the People’s Republic of China on Response to Emergencies and the National Overall Emergency Plan for Public Emergencies, and submit it to the State Council for approval.


The relevant local people’s governments shall organize the formulation of emergency plans for handling large-scale power outages in the power grid in their administrative regions in accordance with laws, administrative regulations and the national emergency plan for handling large-scale power outages in the power grid.


The emergency plan for handling large-scale power outages in the power grid shall make specific provisions on the emergency organization command system and responsibilities, various emergency response measures, and emergency support such as personnel, funds, materials, and technology.


Article 13 Power companies shall formulate their own accident emergency plans in accordance with relevant national regulations.


The power regulatory agency shall guide power companies to strengthen the construction of power emergency rescue teams and improve the emergency material reserve system.


Article 14 After an accident occurs, the relevant power enterprises shall immediately take corresponding emergency measures to control the scope of the accident and prevent the systemic collapse and disintegration of the power grid; if the accident endangers the safety of personnel and equipment, the operating staff of the power plant and substation may immediately take emergency measures such as shutting down the generator set and the transmission and transformation equipment in accordance with relevant regulations.


If the accident causes damage to power equipment and facilities, the relevant power enterprises shall immediately organize emergency repairs.


Article 15 According to the specific circumstances of the accident, the power dispatching agency may issue power dispatching orders such as starting or shutting down the generator set, adjusting the active and reactive loads of the generator set, adjusting the operation mode of the power grid, and adjusting the power supply dispatching plan, and the power generation enterprises and power users shall execute them.


If the accident may cause the destruction of the stability of the power system and large-scale power outages in the power grid, the power dispatching agency has the right to decide to take necessary measures such as load limit, decoupling the power grid, and decoupling the generator set.


Article 16 If an accident causes a large-scale power outage in the power grid, the power regulatory agency of the State Council and other relevant departments of the State Council, relevant local people's governments, and power companies shall, in accordance with relevant national regulations, activate the corresponding emergency plan, establish an emergency command organization, and restore the operation of the power grid and power supply as soon as possible to prevent the occurrence of various secondary disasters.


Article 17 If an accident causes a large-scale power outage in the power grid, the relevant local people's governments and relevant departments shall immediately organize and carry out the following emergency response work:


(i) Strengthen the security protection of key units related to national economy and people's livelihood, national security and public security in the power outage area, prevent acts that undermine social order, and maintain social stability;


(ii) Timely eliminate various dangerous situations caused by power outages;


(iii) If the accident causes major casualties or requires emergency transfer and resettlement of trapped people, timely organize and implement rescue, transfer, and resettlement work;


(iv) Strengthen road traffic command and guidance in the power outage area, and do a good job in railway, civil aviation transportation and communication support;


(v) Organize the emergency production and call for emergency materials to ensure the supply of materials needed for the restoration of power grid operation and basic living materials for residents.


Article 18 If an accident causes power outage to important power users, the important power users shall promptly start their own emergency power supply in accordance with relevant technical requirements; if the start-up of the self-prepared emergency power supply is ineffective, the power grid enterprise shall provide necessary support.


If an accident causes power outage in places where people gather, such as subways, airports, high-rise buildings, shopping malls, theaters, and stadiums, emergency lighting shall be quickly activated and people shall be organized to evacuate in an orderly manner.


Article 19 In restoring the operation of the power grid and power supply, priority shall be given to ensuring the restoration of power supply for important power plants, important power transmission and transformation equipment, and power backbone grids, and to restoring power supply to important power users, important cities, and key areas.


Article 20 The accident emergency command organization or power regulatory agency shall, in accordance with relevant regulations, uniformly, accurately, and promptly release information on the scope of the accident impact, the progress of the disposal work, and the estimated time for power supply restoration.


Chapter IV Accident Investigation and Handling


Article 21 The State Council or the department authorized by the State Council shall organize an accident investigation team to investigate particularly serious accidents.


The State Council power regulatory agency shall organize an accident investigation team to investigate serious accidents.


The power regulatory agency at the place where the accident occurred shall organize an accident investigation team to investigate major accidents and general accidents. If the power regulatory agency of the State Council deems it necessary, it may organize an accident investigation team to investigate a major accident.


For general accidents that do not cause power outages to power users, the power regulatory agency at the place where the accident occurred may also entrust the unit where the accident occurred to investigate and handle the matter.


Article 22 According to the specific circumstances of the accident, the accident investigation team shall be composed of personnel sent by the power regulatory agency, the relevant local people's government, the production safety supervision and management department, and the relevant departments responsible for production safety supervision and management; if the relevant personnel are suspected of dereliction of duty, malfeasance or suspected of committing a crime, the supervisory agency, the public security agency, and the people's procuratorate shall be invited to send personnel to participate.


According to the needs of the accident investigation work, the accident investigation team may hire relevant experts to assist in the investigation.


The leader of the accident investigation team shall be designated by the agency organizing the accident investigation team.


Article 23 The accident investigation team shall conduct an accident investigation in accordance with relevant national regulations and submit an accident investigation report to the agency organizing the accident investigation team within the following time limits:


(I) The investigation period for particularly serious accidents and major accidents is 60 days; under special circumstances, it may be appropriately extended with the approval of the agency organizing the accident investigation team, but the extended period shall not exceed 60 days.


(II) The investigation period for major accidents and general accidents is 45 days; under special circumstances, it may be appropriately extended with the approval of the organ organizing the accident investigation team, but the extension period shall not exceed 45 days.


The accident investigation period shall be calculated from the date of the accident.


Article 24 The accident investigation report shall include the following contents:


(I) Overview of the unit where the accident occurred and the course of the accident;


(II) Direct economic losses caused by the accident and the impact of the accident on the operation of the power grid and the normal supply of electricity (heat);


(III) Causes of the accident and the nature of the accident;


(IV) Emergency handling of the accident and the restoration of power production and power grid operation;


(V) Determination of accident responsibility and suggestions for handling the responsible units and persons;


(VI) Accident prevention and rectification measures.


The accident investigation report shall be accompanied by relevant evidence materials and technical analysis reports. Members of the accident investigation team shall sign the accident investigation report.


Article 25 The accident investigation report shall be submitted to the organ organizing the accident investigation team for approval, and the accident investigation work shall be completed; for general accidents entrusted to the unit where the accident occurred for investigation, the accident investigation report shall be submitted to the power regulatory agency where the accident occurred for approval.


The relevant authorities shall punish the unit where the accident occurred and the relevant personnel in accordance with the law, and impose sanctions on the state employees who are responsible for the accident.


The unit where the accident occurred shall deal with the personnel who are responsible for the accident in the unit.


Article 26 The unit where the accident occurred and the relevant personnel shall seriously learn from the accident, implement accident prevention and rectification measures, and prevent the accident from happening again.


The power regulatory agency, the production safety supervision and management department and the relevant departments responsible for production safety supervision and management shall supervise and inspect the implementation of accident prevention and rectification measures by the unit where the accident occurred and the relevant personnel.


Chapter V Legal Liability


Article 27 If the main person in charge of the power enterprise where the accident occurred commits any of the following acts, the power regulatory agency shall impose a fine of 40% to 80% of his annual income in the previous year; if he is a state employee, he shall be punished according to law; if he constitutes a crime, he shall be held criminally responsible according to law:


(a) Failure to immediately organize rescue of the accident;


(b) Delay or omission of reporting the accident;


(c) Leaving his post without permission during the investigation and handling of the accident.


Article 28 If the power enterprise and its relevant personnel who have an accident commit any of the following acts, the power regulatory agency shall impose a fine of not less than RMB 1 million but not more than RMB 5 million on the power enterprise; the principal person in charge, the directly responsible supervisor and other directly responsible personnel shall be fined 60% to 100% of their annual income in the previous year. If they are state employees, they shall be punished according to law; if it constitutes an act of violation of public security management, the public security organ shall impose public security management punishment according to law; if it constitutes a crime, criminal responsibility shall be investigated according to law:


(1) Falsely reporting or concealing an accident;


(2) Forging or deliberately destroying the accident scene;


(3) Transferring, concealing funds or property, or destroying relevant evidence and materials;


(4) Refusing to accept investigation or refusing to provide relevant information and materials;


(5) Perjury or instructing others to perjury during the accident investigation;


(6) Fleeing after the accident.


Article 29 If a power enterprise is responsible for an accident, the power regulatory authority shall impose a fine in accordance with the following provisions:


(i) In the case of a general accident, a fine of not less than RMB 100,000 but not more than RMB 200,000 shall be imposed;


(ii) In the case of a major accident, a fine of not less than RMB 200,000 but not more than RMB 500,000 shall be imposed;


(iii) In the case of a major accident, a fine of not less than RMB 500,000 but not more than RMB 2 million shall be imposed;


(iv) In the case of an especially major accident, a fine of not less than RMB 2 million but not more than RMB 5 million shall be imposed.


Article 30 If the principal person in charge of a power enterprise fails to perform his/her duties of safety production management in accordance with the law, resulting in an accident, the power regulatory agency shall impose a fine in accordance with the following provisions; if he/she is a state employee, he/she shall be punished in accordance with the law; if he/she constitutes a crime, he/she shall be investigated for criminal responsibility in accordance with the law:


(i) If a general accident occurs, a fine of 30% of his/her annual income in the previous year shall be imposed;


(ii) If a major accident occurs, a fine of 40% of his/her annual income in the previous year shall be imposed;


(iii) If a major accident occurs, a fine of 60% of his/her annual income in the previous year shall be imposed;


(iv) If a particularly major accident occurs, a fine of 80% of his/her annual income in the previous year shall be imposed.


Article 31 If the principal person in charge of a power enterprise is dismissed or criminally punished in accordance with Articles 27, 28 and 30 of these Regulations, he/she shall not serve as the principal person in charge of any production and operation unit within 5 years from the date of the punishment or the date of completion of the execution of the punishment.


Article 32 If the power regulatory agency, the relevant local people's government and other relevant departments responsible for production safety supervision and management have any of the following acts, the directly responsible supervisors and other directly responsible persons shall be punished according to law; if the directly responsible supervisors and other directly responsible persons constitute a crime, they shall be held criminally liable according to law:


(1) Failure to immediately organize accident rescue;


(2) Late reporting, omission, concealment or false reporting of accidents;


(3) Obstruction or interference in accident investigation;


(4) Perjury or instigation of others to perjury during accident investigation.


Article 33 If the personnel involved in the accident investigation have any of the following acts during the accident investigation, they shall be punished according to law; if they constitute a crime, they shall be held criminally liable according to law:


(1) Irresponsible for the accident investigation, resulting in major omissions in the accident investigation;


(2) Sheltering or protecting the persons responsible for the accident or taking the opportunity to retaliate.


Chapter VI Supplementary Provisions


Article 34 If an accident specified in these Regulations occurs and causes casualties or direct economic losses, and the accident level determined in accordance with these Regulations is different from the accident level determined in accordance with the Regulations on the Reporting, Investigation and Handling of Production Safety Accidents, the higher accident level shall be determined and investigated and handled in accordance with the provisions of these Regulations; if the accident causes casualties and constitutes a major accident or a particularly major accident specified in the Regulations on the Reporting, Investigation and Handling of Production Safety Accidents, it shall be investigated and handled in accordance with the provisions of the Regulations on the Reporting, Investigation and Handling of Production Safety Accidents.


If an accident occurs during the production of electricity or the operation of the power grid, resulting in damage to power generation equipment or power transmission and transformation equipment, causing direct economic losses, and does not affect the safe and stable operation of the power system and the normal supply of electricity, the power regulatory agency shall form an accident investigation team in accordance with the provisions of the Regulations on the Reporting, Investigation and Handling of Production Safety Accidents to investigate and handle major accidents, major accidents and general accidents.


Article 35 If these Regulations do not provide for accident reporting and investigation and handling, the provisions of the Regulations on the Reporting, Investigation and Handling of Production Safety Accidents shall apply.


Article 36 The emergency response and investigation and handling of nuclear accidents in nuclear power plants shall be carried out in accordance with the provisions of the Regulations on Emergency Management of Nuclear Accidents in Nuclear Power Plants.


Article 37 This Regulation shall come into force on September 1, 2011.

Generators stop running due to safety failures exceeding industry standards The prescribed overhaul time is two weeks, and the power grid will reduce its load


For thermal power plants with an installed capacity of more than 200 MW of heating units, more than two heating units will stop operating due to safety failures during the heating period specified by the local people's government, causing the entire plant to stop supplying heat to the outside and lasting for more than 48 hours


General accidents


Reduced load of regional power grid by more than 4% but less than 7%


Power grids in provinces and autonomous regions with a power grid load of more than 20,000 MW will reduce their load by more than 5% but less than 10%


Power grids in provinces and autonomous regions with a power grid load of more than 5,000 MW but less than 20,000 MW will reduce their load by more than 6% but less than 12%


Power grids in provinces and autonomous regions with a power grid load of more than 1,000 MW but less than 5,000 MW will reduce their load by more than 10% but less than 20%


Power grids in provinces and autonomous regions with a power grid load of more than 1,000 MW but less than 5,000 MW will reduce their load by more than 10% but less than 20% Power grids in provinces and autonomous regions with grid loads below 1,000 megawatts will reduce their loads by more than 25% but less than 40%


Power grids in municipalities directly under the central government will reduce their loads by more than 5% but less than 10%


Power grids in cities where provincial and autonomous regional people's governments are located will reduce their loads by more than 10% but less than 20%


Power grids in other cities with districts will reduce their loads by more than 20% but less than 40%


County-level cities will reduce their loads by more than 40% (for grid loads above 150 megawatts, reduce their loads by more than 40% but less than 60%)


Power outages for users in municipalities directly under the central government above 10% but less than 15%


Power outages for users in cities where provincial and autonomous regional people's governments are located above 15% but less than 30%


Power outages for users in other cities with districts above 30% but less than 50%


Power outages for more than 50% of users in county-level cities (grid load 150 MW or above, 50% or more but less than 70%)


A power plant or a substation of 220 kV or above has a power outage due to a safety fault, causing the voltage at the surrounding voltage monitoring control point to be 5% or more but less than 10% lower than the voltage curve value specified by the dispatching agency and lasting for more than 2 hours


The generator set stops running due to a safety fault for more than two weeks of minor repair time specified by the industry standard, and causes the power grid to reduce its load


For a thermal power plant with an installed capacity of more than 200 MW of heating units, more than two heating units stop running due to safety faults during the heating period specified by the local people's government, causing the entire plant to stop supplying heat and lasting for more than 24 hours


Note: 1. If one of the circumstances listed in this table is met, it constitutes a power safety accident of the corresponding level.


2. The "above" in this table includes the number itself, and the "below" does not include the number itself.


3. The following terms in this table have the following meanings:


(1) Grid load refers to the actual load of the grid dispatched by the power dispatching agency at the beginning of the accident;


(2) Grid load reduction refers to the maximum reduction in the actual load of the grid dispatched by the power dispatching agency during the accident;


(3) Plant-wide power outage refers to the reduction of the external active load of the power plant to zero (although the load transmitted by the power grid through the power plant bus has not stopped, it is still regarded as a plant-wide power outage);


(4) Generator set shutdown due to safety failure refers to the state in which the grid-connected generator set (including various types of power station boilers, steam turbines, gas turbines, hydraulic turbines, generators and main transformers and other major power generation equipment) needs to stop operating due to safety failure without the permission of the power dispatching agency.
